Terms and guarantee

This is a translation of our Dutch text. If the two differ, the Dutch version applies.

Clear agreements about our unique items and our service.

Great that you are choosing vintage! By shopping vintage deliberately you are being nicely sustainable and giving lovely things the place they deserve again. Who would not be happy about that?!

As a true vintage shopper you know that our items have one or more lives behind them. In fact: just like us, that is probably exactly what makes you happy! Of course you expect quality, but you also understand that a small scratch, dent or ding sometimes comes with it. That, after all, is precisely the charm of a unique item with a story.

Below we explain where you stand. Everything here applies in addition to your statutory rights as a consumer, never instead of them.

These terms apply to everything you buy through nextdoorvintage.nl. You will also come across us on Discogs, Whoppah and Catawiki, and part of our collection is listed in several places at once. If you buy there, that platform's terms apply alongside ours. We always remain your point of contact about the item itself, and your statutory rights as a consumer continue to apply in full.

And one more thing. This page has become rather long, and that is not because we want to cover ourselves, but because we want to be clear about what you can expect. Because that is what we like ourselves! Still have a question, or unsure about something? Do mail us, we are glad to sort it out with you.

2. Product information, dating and provenance

We describe our items as carefully as we can. Signs of use such as scratches, dents or discolouration belong to the age and character of vintage items. The photographs and the description together form the item and are always an integral part of your purchase. The photographs are part of the description; we never use stock images.

  • Dating and provenance. Old objects usually lack a ‘birth certificate’. We determine period, provenance and maker on the basis of marks, construction, use of materials and comparable pieces. We do that carefully, but it remains human work.
  • Wording. If we write “circa 1930”, “probably” or “attributed to”, that is a reasoned estimate and not a certainty. If something is stated without reservation, then we know it, usually because there is a mark or documentation.
  • Later insights. Does an expert later arrive at a different estimate than ours? That in itself is not a defect. If something we claimed without reservation proves demonstrably incorrect, that is a justified complaint.
  • Discrepancies. Does a product not match the description or the photographs? Report it with your order number, clear photographs and a short explanation. How we resolve that is in article 7.

3. Function, safety and use

Our items are often decades old. Proper functioning or modern safety is therefore never a given. To avoid misunderstandings we sell in three categories. Every item states which one applies.

  • Decorative object. This is our default. The piece is complete and has no visible defects, but we have not checked whether it works technically. You are buying it to put on display, not to use. That it does not work is then not a defect.
  • Tested and ready to use. Where this is stated explicitly, we have tested the item and it works as described. If it nevertheless does not work on receipt, your complaint is justified.
  • Parts or restoration object. The piece is incomplete or faulty and is sold as material, not as an object. We describe what is missing or broken as far as we can establish. Whether repair will succeed and whether missing parts are still available anywhere, we do not know — that is for you to find out before you buy.

Unsure which category something falls into, or what exactly is wrong with it? Mail us before you order. Better ten questions beforehand than a disappointment afterwards.

Example of the product block on the website:

Condition and function: Category: decorative object | Function tested: no | Known defects: pendulum missing | Electrics: unchecked old wiring; do not connect to the mains without inspection by a qualified professional.

Safety and specific categories:

  • Electrical appliances. After decades, cables, insulation and earthing are almost always outdated and do not meet current safety standards. We supply these items as antique, unmodified objects capable of restoration. Never connect electrics directly to the mains; always have them checked first by a qualified professional. We are not liable for damage caused by use without inspection.
  • Clocks & timepieces. Clocks and mechanical movements do not travel happily. We always pack sensitive parts (such as the pendulum, weights or key) carefully and separately in the parcel to prevent damage in transit. After receipt a clock needs to be refitted correctly, hung or stood level and regulated. Damage, faults or a clock not running because of incorrect installation, unskilled mounting or wrong regulation does not fall under our responsibility.
  • Toys & children's furniture. Old toys and children's furniture carry no CE marking and have not been tested to modern standards. They may have loose parts, sharp edges or old lead-based paint. We sell these solely as collectors' or decorative objects, not as safe articles for children to use.
  • Tableware, glass & ceramics. Old glazes can contain lead or cadmium that is released by heat, fat and acidic foods. Old crystal, too, almost always contains lead. We do not test for this and sell tableware, glass and ceramics as decorative objects. If you do want to use them for consumption, have them tested first. Never use them in the dishwasher, microwave or oven, and do not store food in them for long periods.
  • Animal materials. We sell only legal Dutch natural products (such as roe deer antlers and rabbit skins) as decoration. These are natural products: they may shed hairs, have a scent of their own and react to damp or sunlight. If you live outside the Netherlands, please check your local import rules yourself.

4. Records, CDs and other music carriers

We do not sell our music collection through this shop but through Discogs, where everything is graded piece by piece according to the international standard: nextdoorvintage_nl on Discogs.

Our Discogs Seller Terms apply there. Your rights are the same as here: 14 days to change your mind, a refund including the outbound shipping costs, and protection if an item is not what we said it was. It simply runs through the order page on Discogs.

If a music carrier does appear in this shop, in a lot or with a device for instance, then articles 2 and 6 to 8 simply apply.

5. Arrived damaged

Until the moment you, or someone you have appointed, takes receipt of the parcel, the shipment is our risk. If it goes missing or is damaged along the way, that is our concern and not yours.

We pack everything sturdily and reuse packaging material wherever we can. Nicely sustainable, and it takes nothing away from the safety of your parcel! Even so, something can go wrong. If you take a product out of the packaging broken, let us know as soon as you can, preferably within 48 hours. Not because your rights lapse otherwise, but because we can still hold the carrier to account at that point.

What we need:

  • your order number
  • clear photographs of the damaged product
  • photographs of the packaging, inside and out
  • a clear photograph of the shipping label on the box
  • keep the packaging if you can until the complaint has been settled

Exception. A mechanical clock that needs to be levelled, refitted or regulated again after transport does not count as transport damage. That is simply part of putting a vintage timepiece into use.

If you arrange a carrier or forwarding service yourself, the risk passes as soon as we hand over the parcel.

6. Cooling-off period and returns

You have 14 days to change your mind, counting from the day after you received the order. Within that period you let us know that you wish to withdraw from the purchase. An email is enough; you do not have to give a reason. Prefer to use a form? You will find the model withdrawal form at the bottom of our returns page, and you can always request it from us.

After your notice you have another 14 days to send the item back or bring it back.

  • What we refund. Within 14 days of your notice we refund the purchase amount, including the standard shipping costs you paid with the order. If you chose a more expensive shipping option, we reimburse the standard rate. We may wait to refund until we have accepted the item or until you have shown that you sent it.
  • What you pay. The cost of the return shipment is for the buyer's account. For fragile or heavy items, choose shipping with track and trace and pack it just as sturdily as we did. For items that cannot go by parcel post, you arrange the return transport yourself; count on € 100 to € 250, depending on distance and size. Until we have accepted the item, the risk lies with you as the buyer. That also applies to pieces you bring back or have brought back.
  • How you handle the item. You may unpack an item and look at it as you would in a shop. If you go further than that, for instance by opening a device, assembling something or cleaning it, we may offset the loss in value against your refund. Our product photographs in the shop are decisive in that respect.
  • Exception. Items adapted at your request or put together specially for you fall outside the cooling-off period.

You will find the return address at the bottom of this page. Always report your return first, then we know it is coming.

7. When your complaint is justified

Does an item demonstrably differ from the description or the photographs, or did it arrive damaged? Then your complaint is justified and we will look for a solution together.

Because our items are unique, replacement with an identical piece is usually not possible. Repair sometimes is. If neither works, you choose between a partial refund where you keep the item, or a full return against a refund of the whole amount.

Where a complaint is justified, the return costs are ours. That is the difference from an ordinary change-of-mind return under article 6.

8. When a complaint does not hold

We do not offer a manufacturer's warranty; on vintage, antique and used items that are often 20 years old or more, such a thing simply no longer exists. What you do have is your statutory right that an item conforms to what was agreed: to the description, the photographs and the ‘Condition and function’ specification block in the product description in the shop.

An appeal to that does not hold where:

  • damage has arisen through dropping, knocking, damp or incorrect use after receipt
  • you have carried out repairs or modifications yourself, or had them carried out
  • it concerns ageing or signs of use that befit the age of the item
  • it concerns a characteristic we had already pointed out

These provisions do not affect your statutory consumer rights.

9. Complaints and disputes

Not happy about something? Let us know at the email address at the bottom of this page. You will get an acknowledgement within 3 working days and a substantive reply within 14 days. If we need longer, we will tell you when you can expect an answer.

If we cannot resolve it together, you can bring your dispute before the competent Dutch court. You can also turn to the Dutch legal aid service (Juridisch Loket) or, for a cross-border purchase within the EU, to the European Consumer Centre.

10. Ordering, prices and payment

All prices are stated in euros and include VAT. You can pay through Apple Pay, Google Pay, iDEAL, credit card, Klarna, PayPal and Bancontact. Your order is final as soon as we have received your payment and you have had an order confirmation by email.

If you pay later through Klarna, you pay Klarna and their payment terms apply alongside ours. For the purchase itself we remain your point of contact. If you send something back, report it to Klarna as well, otherwise the payment stays open.

Each of our items is unique and some are listed on several platforms at once. Very occasionally an item turns out to have been sold already after you ordered it. We will let you know immediately and refund the full amount within 5 working days. Obvious errors in prices or descriptions do not bind us; if we discover such a mistake, we will contact you and you may cancel at no cost.

11. Shipping and delivery

We send your order within 4 working days of receiving your payment. How long the parcel is then on its way depends on the carrier. You see the shipping costs in the basket before you check out.

If we ever do not manage it within those 4 working days, because of a holiday or illness for example, we will tell you and give you a new date. If it then still takes too long, you may set us a reasonable extra period. Should that pass as well, you can cancel the purchase at no cost and you will have your money back within 14 days.

  • Where we ship to. We ship within the European Union. Islands belonging to an EU country, such as Mallorca, Sicily or Crete, are simply included; do count on a longer delivery time there. What we do not do is ship to territories falling outside the customs and VAT territory of the EU (such as the Canary Islands, French overseas departments, the Caribbean Netherlands). Do you live in such an area? You can order perfectly well, but you then arrange a carrier yourself or collect the item. From the moment we hand the parcel to your carrier, the risk passes to you.
  • Large objects and collection. Cabinets, longcase clocks, chairs and other heavy or large pieces are not something we send by parcel post. The item states that collection only is possible. Collection in Oldenzaal is free of charge and by appointment. If you would still like such a piece delivered, you engage a carrier yourself, after consulting us. The costs are for your account and the risk passes as soon as we hand the piece over.
  • Returning large objects. With these items too you have 14 days to change your mind. If you do, you collect it back at your own expense and convenience, or have it collected. Count on € 100 to € 250 in transport costs, depending on distance and size. We take the item back by appointment; until that moment the risk lies with you.

You will find the shipping rates by weight and destination on our page Shipping and payment.

12. Business buyers

If you buy as a business (B2B), articles 6 to 9 do not apply. There is then no cooling-off period, no right of withdrawal and no statutory consumer protection.

  • Invoicing. Business orders are provided with an invoice stating VAT separately, on the basis of our regular administration.
  • Warranty and defects. Items are sold in the condition they are in at the moment of delivery, with the exclusion of warranty. Visible defects must be reported to us in writing within 5 working days of receipt.

13. Copyright and intellectual property

All texts, product descriptions, photographs and other content on nextdoorvintage.nl are our property and protected by copyright. We make all our photographs and texts ourselves. Copying, reusing, distributing or using images or texts from our shop for commercial purposes is not permitted without our prior written consent.

14. Privacy

We handle your data with care and use it only to process your order. Exactly how we do that is in our privacy statement.

15. Applicable law and force majeure

Dutch law applies to all our agreements. If you live in another EU country, you retain the protection of the mandatory provisions of your own country.

Sometimes something goes wrong that we can do nothing about: illness, fire, water damage or a disruption at our carrier. In such cases we may suspend our obligations for as long as the situation lasts. If it takes longer than is reasonable, both you and we may cancel the purchase with a full refund within 14 days. We do not compensate further costs or damage in that situation.
